COURSE ADVISOR LUCKY DRAW CONTEST
- ORGANISER
This Lucky Draw Campaign (“Campaign”) is organised by Course Advisor Sdn Bhd [Company No. 201801018839 (1280855-T)] (“Organiser”), an education and student recruitment company appointed by the Private Higher Education Institutions established under the Private Higher Educational Institutions Act 1996 hereinafter collectively known as BAC Education Group (BAC) listed and set out specifically in Appendix 1 annexed hereto.
The Organiser reserves the right to amend these Terms and Conditions at any time subject to applicable law.
- CAMPAIGN PERIOD
The Campaign shall run from:
Start Date: 1st March 2026
End Date: 31st October 2026
(“Campaign Period”)
Entries received outside the Campaign Period shall not be eligible.
- ELIGIBILITY
3.1 The Campaign is open only Participating Students who are defines as follows:-
- Duly registered students (Malaysians and international students with valid student visas) of BAC with a valid driving license in Malaysia; and
- Being a full time students enrolled for a non-ODL MQA accredited programmes run by BAC and pursuing said programme in Malaysia; and
- BAC Students who have fully settled their tuition fees and resource fee in a single lump sum payment for the course registered but before the commencement of the respective intake
3.2 The following are not eligible:
- Staff, directors, and immediate family members of the Organiser or the BAC ecosystem*;
- BAC Students with outstanding disciplinary proceedings;
- Students who subsequently withdraw, defer, or terminate enrolment before the prize is awarded.
*Participating Students declare as follows:-
- That he/she has no personal, financial, or familial relationship with any employee or officer involved in the administration of this Luck Draw Campaign.
- That he/she has not received any preferential treatment in connection with this Lucky Draw Campaign.
- That he/she shall immediately disclose any actual or potential conflict of interest and that any failure to disclose may result in disqualification and clawback of the Prize.
3.3 Payment via instalment plans, PTPTN part payment, scholarships, corporate sponsorships, or third-party education financing shall not qualify unless the full tuition fee is received by the Organiser before commencement of the student’s respective intake.
- HOW TO QUALIFY
4.1 One (1) automatic entry will be granted for every eligible student who:
- Pays 100% of tuition fees and resource fee in one lump sum (as per 3.1 or 3.3 above; and
- Completes and submits the Official Campaign Participation Consent Form.
4.2 No additional entries shall be given for higher fee amounts.
4.3 This Campaign is a promotional lucky draw and does not involve the purchase of lottery tickets or additional payment beyond normal tuition fees.
- PRIZE
5.1 The prize consists of: One (1) MINI John Cooper Works EJ01 (12HF), Midnight Black II, (“Prize”), wrapped with BAC’s logo /design *
*The colour and image of the Prize featured in any marketing material is not representative of the actual Prize. The colour of the Prize will be decided by the Organiser. Stickers & Designs which would include the logo and other promotional banner adverts of the Organiser / BAC shall be also placed on the Prize for a minimum period of 365 calendar days from the official handover
5.2 The Prize:
- Is non-transferable;
- Is not exchangeable for cash;
- Is awarded on an “as-is” basis;
- Includes standard manufacturer warranty only.
5.3 The Organiser shall bear:
- Basic registration cost;
- Standard road tax for the first year.
5.4 The Winner shall bear:
- Insurance costs;
- Additional accessories;
- Personal tax liabilities (if applicable);
- Any costs beyond those expressly stated in these Terms.
5.5 The Organiser reserves the right to substitute the Prize with another item of equivalent value without prior notice.
5.6 The Winner agrees irrevocably to the following:-
- To not remove the vehicle wrap of the Prize with BAC’s logo/design in any circumstances for a minimum of 365 days from official handover of the Prize unless agreed to in writing by the Organiser. In the event the Winner removes the said wrap on the Prize or damage the wrap on the Prize in any manner, he/she shall pay the Organiser a penalty of RM50,000.00.
- That the risk and responsibility over the Prize pass to the Winner upon official handover.
- WINNER SELECTION
6.1 Only One (1) Winner will be randomly selected from the eligible participants.
6.2 The Winner shall be selected through a random draw conducted:
- In the presence of senior university representatives; and
- Where required, in accordance with applicable Malaysian regulatory requirements.
6.3 The Draw Date shall be: 4th November 2026 (Draw Date)
6.4 The name of the Winner will be published on the landing page of the Organiser (courseadvisor.asia) and the Winner will be notified via:
- Official college / uni.college / university email; and/or
- Registered contact number.
6.5 The Prize must be collected in person or by an authorized representative at a venue to be announced on the Draw Date. If the Prize remains unclaimed after expiry of 30 calendar days from the Draw Date said Prize shall be forfeited.
6.6 The winner must produce:
- Valid student identification;
- NRIC / Passport (with valid student visa) and driving licence;
- Proof of enrolment status at BAC.
Proof of identity must be provided for the collection of the Prize. Winner must also present a valid driving licence. No right to compensation shall accrue nor be given to the Winner if he/she fails to provide proof of identity, valid driving licence as well as his/her relevant personal details accurately to the Organiser and/or BAC a at the point of collection.
6.7. The Winner whose Prize has been forfeited shall not be entitled to any compensation for any reason whatsoever. The Organiser / BAC shall be free to deal with the Prize as they deem fit.
6.8 The decision of the Organiser is final and binding. No appeals shall be entertained.
- WITHDRAWAL / REFUND IMPACT
If a winning student:
- Withdraws,
- Defers,
- Requests tuition fee refund, or
- Is dismissed for misconduct
before the official prize handover, the Organiser reserves the right to revoke the Prize.
The terms of BAC’s Refund Policy shall apply in respect of the withdrawal /refund. Participants are deemed to have read and understood said Refund Policy.
- STRUCTURED VEHICLE (PRIZE) CLAWBACK MECHANISM
The Winner irrevocably acknowledges and agrees that:
8.1 If he/she :
- Withdraw, defer, or terminate enrolment;
- Receive any tuition refund (full or partial);
- Are dismissed for misconduct;
- Are found to have misrepresented eligibility;
within twelve (12) months from prize handover, the Organiser shall have the right to:
(a) Require return of the Prize in good condition (fair wear and tear excepted); OR
(b) Recover from the winner the full retail value of the Prize at the time of award and to execute any necessary documentation to effect such recovery.
8.2 This clawback obligation survives graduation, withdrawal, or termination.
- TAX IMPLICATIONS
9.1 Any personal income tax, benefit-in-kind tax, or other statutory tax liability arising from acceptance of the Prize shall be the sole responsibility of the Winner.
9.2 Participating Students are advised to seek independent tax advice.
- PUBLICITY CONSENT
10.1 It is a condition precedent to this Contest that all Participating Students consent to the public disclosure of their names, likeness, (including photographs & Video) and particulars for publicity purposes connected with this Contest without payment or compensation. Winners also consent to cooperate with and participate in publicity activities relating to the Contest organized by the Organiser and/or BAC and/or their authorised representatives without any compensation whatsoever.
10.2 By taking part in this Lucky Draw Campaign, Participating Students agree that the Organiser and/or BAC and/or authorised affiliates may:
- Use their name, photograph, video, likeness, programme enrolled, and testimonials;
- For marketing and publicity purposes;
- Without additional compensation.
10.3 Participants shall not withdraw publicity consent after entering in the Lucky Draw Campaign.
- PERSONAL DATA PROTECTION
11.1 Participants agree that their personal data shall be collected and would be processed in accordance with the Personal Data Protection Act 2010 (as amended 2024) and the Organiser’s Privacy Notice.
11.2 Data may be used for:
- Campaign administration;
- Verification;
- Regulatory reporting;
- Marketing communications (subject to consent).
11.3 Participating Students may exercise data access and correction rights in accordance with PDPA requirements.
11.4 Personal data collected for the purposes of the Lucky Draw Campaign shall be destroyed within one (1) month from the Draw date.
- COMPLIANCE WITH LAW
12.1 This Campaign shall not constitute an unlawful lottery under Malaysian law.
12.2 No additional payment or consideration beyond normal tuition fees is required to participate.
12.3 The Organiser reserves the right to suspend or cancel the Campaign if required by regulatory authorities including:
- Ministry of Higher Education (MOHE);
- Ministry of Finance;
- Local licensing authorities.
- LIMITATION OF LIABILITY
The Organiser shall not be liable for:
- Mechanical defects of the Prize;
- Road accidents;
- Insurance disputes;
- Any indirect or consequential losses.
All risks pass to the winner upon handover.
- FORCE MAJEURE
The Organiser shall not be liable for delay or cancellation due to events beyond its reasonable control.
- GOVERNING LAW
These Terms shall be governed by the laws of Malaysia.
Any disputes shall be subject to the arbitration process as set out herein
- ARBITRATION CLAUSE
Any dispute arising out of or in connection with this Campaign or this Consent Form shall be resolved by arbitration in Malaysia in accordance with the Arbitration Act 2005.
- The seat of arbitration shall be Kuala Lumpur.
- The arbitration shall be conducted by a single arbitrator.
- The language shall be English.
- The decision of the arbitrator shall be final and binding.
The parties waive the right to commence court proceedings except for enforcement of an arbitral award.
- INDEPENDENT LEGAL ADVICE
All Participating Students also confirm and acknowledge that:
- He/she has been given reasonable opportunity to seek independent legal advice before participating.
- He/she has entered into this Lucky Draw Campaign voluntarily and without coercion.
- He/she fully understands the legal consequences of the terms set out herein.
- INDEMNITY
The Winner shall indemnify and hold harmless the Organiser and BAC against:
- Any third-party claims arising from my use of the Prize;
- Traffic offences, accidents, or penalties;
- Any tax or statutory liabilities associated with the Prize.
In the event the Winner removes the BAC wrap on the Prize or damage the wrap on the Prize in any manner, he/she shall pay the Organiser a penalty of RM50,000.00.
